Dr Carri Ginter moderated a panel titled “War of Law” at the conference “Economic Security 2023” (Majandusjulgeolek 2023). This prominent conference took a thorough insight into the security world today with notable speakers such as President Toomas Hendrik Ilves, Minister of Foreign Affairs Urmas Reinsalu, British journalist and political observer Eduard Lucas, Konstantin EGGERT, Deutsche Welle Journalist on Russian affairs in the Baltic States and many others.
Dr Ginter’s panel consisted of Academic Prof Lauri Mälksoo, Erki Kodar, the Undersecretary for Legal and Consular Affairs at the Ministry of Foreign Affairs of Estonia and Tiina Pajuse, Professor of International Law and Security Studies at Tallinn University.
The panel discussed various topics, such as
- Potential set-up of a tribunal to deal with the Russian aggression and the war crimes in Ukraine and whether or not the tribunal should revisit Russian crimes from WW2
- Historical perspective of the League of Nations and the limitations of the United Nations in dealing with the conflict
- Various alternative dispute resolution mechanisms in use, such as investor-state arbitration and previous international experiences and the Achmea limitations
- Practicalities of international politics in gaining support for Ukraine in international institutions
- Practical tips on what the audience members can do to support Ukraine in its effective “War of Law.”
The sentiment in the audience and the panel was uniform. The significance of international law, albeit its limitations, stands in the centre of winning the legal law and maintaining a moral upper hand.
