Carri Ginter and Maarika Maripuu on amended hate speech section

Dr Carri Ginter and lawyer Maarika Maripuu have published an article on the amended hate speech section.

Dr Ginter and Maarika Maripuu have found that the draft act is well-crafted and will only criminalise hate speech that threatens public order. The law will not criminalise behaviour within the bounds of freedom of expression, such as offensive or shocking behaviour in public.

However, legal scholars have criticised the draft as too abstract and creating a burden for the judiciary. The explanatory memorandum to the draft act explains that hate speech that poses a severe threat will be prohibited, but noise-making and insulting passers-by will not be punished.

Dr Ginter has also appeared on Vikerraadio to discuss the amendments to the hate speech section.
